Proposed Cottonwood Annexation
On January 6, 2021 the City received a 10% Notice to Commence Annexation petition submitted by Cottonwood Investors, LLC, owner of land located on Cottonwood Road and west of Kendall Road (see map).
On April 28, 2021 the Walla Walla City Council Passed Resolution 2021-65 accepting as modified the Annexation Petition of the owner, (Cottonwood Investors, LLC) to annex approximately 104 acres of property being generally located east of Cottonwood Road and West of Kendell Road including the right-of-way of Cottonwood Road from the current city limits of Kendall Road. On April 1, 2021, the annexation petitioner (Cottonwood Investors, LLC) applied to the City for a Development Agreement in conjunction with the proposed annexation. Cottonwood Investors, LLC proposes a residential subdivision of the 104.62 acres into 250 single-family residential lots and also proposes the devoting 25.4 acres for open space/park (see Development Agreement application).
A Development Agreement is a mechanism by which the City and a developer may address development standards and other provisions that shall apply to, govern, and vest future development. City Staff recommended that the City Council accept the Annexation Petion on condition of entering into a Development Agreement to address impacts from the proposed future development.
Resolution 2021-65 section 5 provides that acceptance of the annexation petition is conditioned on the Developer and the City of Walla Walla entering into a Development Agreement “which sets the development standards and other provision that shall apply to and govern the development, use and mitigation of the development of the property for the duration of the agreement.”
By passing Resolution 2021-65 the City Council agreed to a process whereby the Development Agreement shall be reviewed, which postpones the annexation legislative process pending the outcome of the quasi-judicial Development Agreement process. This provides an opportunity for the public to make comment and provide public testimony on the Development Agreement. Below is a timeline showing the Development Agreement review process and how it relates to possible future annexation.
